Securing Parentage

A fertility lawyer helps establish legal parentage for families created through assisted reproductive technologies to ensure your parental rights are protected from the start.

A fertility lawyer plays a crucial role in establishing legal parentage for individuals and couples growing their families through assisted reproductive technologies. From assisting a Confirmation Adoption to

securing Pre- or Post-birth parentage orders, a fertility lawyer ensures that your rights—and those of your future child—are clearly protected under the law.

Confirmation Adoption

In 2022, Colorado passed Marlo’s Law. This law aims to make the adoption process easier for LGBTQ parents and many other couples. It creates a streamlined process for parents using assisted reproductive technology, who are not related to their child or did not give birth to them, to affirm their legal rights. Patterick Law can assist couples in securing these adoptions and provide peace of mind about your legal parental rights.

Pre- or Post-Birth Orders

What is a Pre-Birth Order?

This document is a court order that gives all parental rights to the Intended Parents. This includes an order that the Intended Parents should be listed on the child’s birth certificate and have the right to name their child. This document also removes the Gestational Carrier from having any parental rights or obligations once the child is born.

What is a Post-Birth Order?

A post-birth order may be required to have the Gestational Carrier’s name removed from the birth certificate if the child was born in a jurisdiction that requires the Gestational Carrier’s name to be listed on the birth certificate initially.
